The Allahabad High Court in Uttar Pradesh has recently given a big decision while hearing the bail plea of the accused in a rape case. The High Court has said that if a woman does not resist while making physical relation, then it cannot be said that the relation was against her will. Justice Sanjay Kumar Singh made the remarks while hearing criminal proceedings against a man accused of raping a 40-year-old married woman. Ironically, the accused was her live-in partner. The court noted that the alleged rape victim, without divorcing her husband and leaving her two children, decided to remain in a live-in relationship with the petitioner Rakesh Yadav with the intention of marrying him.
