High Court Stops Commissioner’s Order, Vidhan Sabha member Vijay Mishra to Demolish Illegal Portion Himself.

In a case related to the demolition of residential and commercial buildings in Allapur owned by Vidhan Sabha member Vijay Mishra in Gyanpur, the Allahabad High Court has issued a stay order against the order of the Prayagraj Mandal Commissioner. The Mandal Commissioner had directed the Prayagraj Development Authority to adhere to the demolition notice after hearing the arguments of Yachi Indrakali and Ramlali. This order is now being challenged in the High Court by the Prayagraj Development Authority (PDA).

During Wednesday’s hearing in Justice Ashwani Kumar Mishra’s court, Ramlali’s lawyer stated that Yachi wants permission to demolish the illegal construction in her building herself. The Special Judge of the Gangster Act was also informed about the High Court’s order. The Special Judge had previously placed an embargo on any alteration to the structure of Vijay Mishra’s buildings under the Gangster Act, stating that they were seized properties under the Act.

The court asked for a sworn statement from Ramlali’s counsel regarding this claim. Her lawyers requested time to negotiate with the architect and submit an affidavit. The court accepted this, giving a deadline of November 9th for filing the affidavit. Until then, a stay order on implementing the Mandal Commissioner’s directive remains in place. The PDA began implementing this order in October 2020, but Yachi and Ramlali challenged it in the High Court. The court directed Yachi to file an appeal against the demolition notice in accordance with the rules, as the notice was not provided to her in Tamil as required. The Mandal Commissioner sent the case back to the PDA after hearing Yachi’s arguments to validate the order. The PDA has now challenged this order in the High Court.
